Little has been said about McGrath's anti-liberal tendencies.  His testimony in the Bromgard v. Montana law suit will become public.  His attempt to seal his testimony in that case -- to hide it from the public -- will come out.  His refusal to review the cases of hundreds of defendants who may have been wrongfully convicted by the junk science of the former crime lab director will become public.  His opposition to the post-humous pardons for 78 Montanans convicted of sedition during WWI will become public.  His delay of the settlement of the ARCO case until he became a candidate, will become public.  His timidity will become public (why didn't he call Racicot on Racicot's "altar of the first amendment speech" in the 1988 election?)  His inexperience will become public (the Court does more than criminal cases.)

Compare Waterman's litigation (at no charge) to abolish the death penalty; his effort (at no charge) to revamp the Public Defender system; his work on behalf of gays and lesbians; his representation of Bromgard all put him solidly in the liberal camp.
