Flathead judges recuse themselves from Barkus "case"

by: Jay Stevens

Tue Sep 22, 2009 at 07:20:35 AM MDT

The latest on the Flathead Lake Boat Crash: three Flathead area judges have recused themselves from any case involving Greg Barkus.

Er...there's no case!

And weren't Barkus' BAC results supposed to have reached Montana by now? I was, you know, joking when I suggested they were coming by horse...wasn't I? Or are the results protected by Judge Curtis' gag order?

The real news, then, will come when Flathead County officials announce that they're charging Barkus or not. And you have think, with the delay and judges scrambling to get out of the way, maybe - just maybe! - charges are coming... But who knows? I sure don't.

It's good to be a Republican in the Flathead! (maybe they're hopin' to get the eventual charges dismissed for lack of a speedy trial.  Heck, I would!)

Just watch.

Well.. (0.00 / 0)
they've sealed Barkus' medical records.I suppose the BAC was part of that.

That's got to be extremely unusual.  I mean - does any other typical DUI suspect have that sealed?

Beyond that - what is the validity of that seal, now that about 50 judges have had to recuse themselves because they know Barkus?

Wish we had a lawyer around.  I could see sealing all kinds of medical information - but that BAC was done at the request of the law.  That isn't exactly equal to the personal medical records.

Ahh...Wulfgar! is right.  Bullpucky going on, make no doubt...along with lots of posturing to figure out how to sweep this away.

A week plus and...? (0.00 / 0)
This is long gone.  The media has been stonewalled thanks to the court motions...  My guess is that Wulfgar is right, this is over.  I just wonder, will some reporter pick the ball back up again?

The party of "personal responsibility" at work.  We'll likely never know if Barkus was drunk or not, as it will undoubtedly never be released.

This double standard is too much.
