Here's some great news:

A federal appeals court on Friday ordered the dismissal of a lawsuit challenging President Bush's domestic spying program, saying the plaintiffs had no standing to sue.

What does standing mean? It means that the people suing couldn't prove the government was surveilling them? Presumably, that proof would come in the form of a "smoking gun" like being declared a enemy combatant and getting thrown into a dark hole somewhere with no habeas corpus rights.

This is truly incredible. A secret wiretapping program that evades scrutiny because it is secret. Good work, judges, you've made a mockery of the Constitution.

hate to say it but a foundation of our federal courts states that if the plantiffs can not show any harm then they don't have standing. I may not take you to court for the appearance or potential of harm. And I imagine that it is going to be very hard for anyone to prove that a secret wiretaping program has harmed them. We are going to have to use congress to change this prarticular program.

The entire country's privacy rights have been thrown out the window without judicial review. In other words, we all now get to presume -- because we have no way of knowing -- that all of our communications are being monitored.

I didn't realize that living in a police state didn't bring non-economic harm.
